License to use the AndroidTM Application
TERMS OF USE – GOOGLE
The content, operation and use of Loto Québec's web site as well as any application linked to the site and made available on a mobile device such as a smart phone or a tablet computer are governed by the General Conditions Governing the Use of the Internet Sites Operated by Loto Québec and its Subsidiaries ("Loto Québec's General Conditions"). The terms and conditions contained in the License to use the application are in addition to Loto Québec's General Conditions.
LICENSE TO USE THE APPLICATION
By downloading the Application, you accept to be bound by the following terms and conditions.
SCOPE OF LICENSE
The right to use the Application is granted to you by Loto Québec and its subsidiaries ("Loto Québec") under license. The Application is not sold to you. This license to use the Application ("License") governs the content and operation of the Loto Québec Application ("Application"), as well as each person’s authorized use of the Application. Loto Québec reserves all rights not expressly granted to you.

The Application is non-transferable, and you are allowed to use it only on devices that you own or control ("Device"). You may not distribute or make the Application available over a network where it could be used by multiple devices at the same time. You may not lease, transfer, lend or sublicense the Application. You must delete the Application from your Device before you sell or otherwise transfer your Device.
MODIFICATIONS
Loto Québec may modify the License at any time without prior notice. Therefore, it is recommended that you consult this License regularly in order to remain apprised of the applicable terms and conditions.
The License will govern any upgrades provided by Loto Québec that replace and/or supplement the original Application, unless such upgrade is accompanied by a separate license in which case the terms of that license will govern.
SERVICES OFFERED
The Application is exclusively reserved to users aged 18 years or over and residents of Québec. It can only be used if location services are enabled.
Subject to compliance with the License and Loto-Québec’s General Conditions, including the Specific Online Gaming Conditions of Use (the “Online Gaming Conditions”), the Application allows you, among other things, to:
- register on Loto Québec’s online gaming site and open an account on lotoquebec.com;
- open a gaming session in order to play different online games (“Games”), that is lottery Games, Instants and casino;
- for lottery Games:
- proceed with the online purchase of your selection or your play*;
- check your terminal-issued tickets;
- view draw results for different lotteries;
- create a lottery group or join an existing group;
- prepare and save your selections or your play* in order to generate a bar code and conclude the purchase transaction at a Loto Québec retailer and have your lottery ticket issued by the retailer;
- for casino Games, access and play Games that are compatible with a mobile device, including:
- slot machines,
- table,
- live casino,
- Keno,
Games, excluding sports betting, bingo and poker;
- if you have an account on lotoquebec.com:
- access and manage your account on lotoquebec.com, including to conduct a transaction, view your transaction history, payment methods or see prizes that you have won, which are paid directly into your account on lotoquebec.com;
- receive, at your request, notifications (e.g.: on upcoming jackpots of certain lotteries, latest news and promotions).
* Only selections or plays registered by Loto‑Québec’s central computer system participate in the game.
In the event of a discrepancy between the results indicated in the Application and those of Loto Québec’s official winning list, the latter shall prevail.
The content and operation of the lotoquebec.com website are governed the Online Gaming Conditions, which apply in addition to the License. In the event of a discrepancy between a condition stated in the License and a condition stated in the Online Gaming Conditions, the latter shall prevail.
The Games offered are governed by the applicable Regulations, which include limitations of liability, as well as by the game rules of each lottery or casino game.
FINGERPRINT OR FACIAL RECOGNITION LOGIN TO YOUR ACCOUNT ON LOTOQUEBEC.COM
One of the functionalities of the application is to allow you to log in to your account on lotoquebec.com using your fingerprint or facial recognition instead of your personal identification code comprised of a username or email address and of your password.
This functionality is optional, and you may turn it off at any time.
Your personal identification code remains valid and, if you turn off the functionality, you will be able to use your username and password to log in to your account on lotoquebec.com.
The functionality is only available if your Device supports fingerprint or facial recognition authentication.
To do so, you must turn on and set up the functionality on your Device. You will then be able to associate your fingerprint or facial data to your account on lotoquebec.com. As long as the functionality is turned on, your fingerprint or facial data, enrolled in your Device settings, can be used as a personal identification code to access your account on lotoquebec.com.
All fingerprints or facial data enrolled in your Device settings can be used to log in to your account on lotoquebec.com. You are solely responsible for ensuring that only your own fingerprint or facial data is associated to your account on lotoquebec.com.
If children under the age of 18 have access to your Device, we recommend using your personal identification code to authenticate because it is possible that they may unlock your Device and connect to your account on lotoquebec.com using fingerprints or facial recognition.
You are solely responsible for preserving the confidentiality of your personal identification code, as specified in the Online Gaming Conditions.
Loto Québec does not store any images or other data regarding your fingerprint or your face.
THIRD PARTY SERVICES
The Application may enable access to Loto Québec’s and/or third parties’ web sites and services. When using the Application you agree to comply with applicable third-party terms of agreement. For example, the use of the Application or services may require Internet access which may be subject to additional terms of service that you agree to comply with.
ELIGIBILITY
By logging in to your account on lotoquebec.com via the Application, you confirm to Loto Québec that you are aged 18 years or older and are a resident of Québec.
PRIVACY
Loto-Québec’s Privacy Policy applies to you when using the Application.
Loto Québec reserves the right to publish the name, region, photograph and any other information related to the winning of all winners, including in social media.
The Application may collect some of your personal information with your consent, such as your username and password, for identification purposes only. Such information is exchanged automatically between your Device and Loto Québec's and third parties’ servers. In addition, your Device ID is recorded and stored when you request to receive notifications.
LIMITATION OF LIABILITY
Loto Québec offers no guarantee whatsoever with regards to the Application and, by using it, you agree to use the Application as is and at your own risk.
Loto Québec, its administrators, employees or agents shall not be held in any way responsible under civil law or otherwise for any losses or damages of any kind whatsoever, including loss of data or damages to your Device, related to the use of the Application, including browsing any Internet site linked to the Application by hyperlink or otherwise, or the inability to access or use the Application, including in case of:
- failure, defect or destruction of the Application or information systems used in relation with the Application;
- delays or lateness, however caused, which preclude anyone from accessing or consulting the draw results or requested notifications, accessing or using an account on lotoquebec.com, completing an online purchase or having a selection or a play registered or having a lottery ticket issued, in a timely manner;
- errors, omissions, inaccurate or outdated information presented in the Application;
- the consequences of any harmful programming code that could install itself in the Application or be transmitted via the Application;
- failure, delay or other like circumstances attributable to third parties involved in the provision of services, including suppliers of telecommunication services or equipment;
- failure, defect or other like circumstances attributable to the use of outdated browsers or devices.
You understand and agree that Loto Québec may, at any time and at its sole discretion, cease to offer the Application, withdraw, update or modify it, without incurring any liability on its part. Moreover, Loto Québec shall not be held liable if it decides to decline, deactivate, block, suspend or terminate your right to use the Application. Loto-Québec reserves the right to take any other measure it deems appropriate due to non-respect of the License or for any other reason it deems relevant.
INTELLECTUAL PROPERTY
Certain names, words, titles, expressions, logos, icons, graphic elements, drawings and diagrams or other content appearing in the Application are commercial designations or trademarks held by Loto Québec, or commercial designations or trademarks granted to it by virtue of a license. All other material contained in the Application is also protected by copyright. The unauthorized downloading, retransmission, copying or modification of trademarks, images, text or data contained in the Application may contravene federal or provincial laws, and especially the laws pertaining to patents, trademarks, industrial drawings or copyright. Except for the purposes of using the Application, or unless otherwise indicated, it is strictly prohibited to copy, redistribute, reproduce, republish, store on any medium, retransmit or modify the information contained in the Application, or to make public or commercial use thereof in any way whatsoever. You may not decompile, reverse engineer, disassemble, attempt to derive the source code of, or create derivative works of the Application, any updates, or any part thereof. Any attempt to do so is a violation of Loto Québec’s rights and may be subject to prosecution.
TERMINATION
Loto-Québec reserves the right to terminate the License and, consequently, terminate the use of the Application, at any given time. Your rights under the License will terminate automatically without notice should you fail to comply with any term(s) of the License. Upon termination of the License, you shall cease all use of the Application, and destroy all copies of the Application.
LANGUAGE
In the event of a discrepancy between the French and English versions of the License, the French version shall prevail.
JURISDICTION
Any conflict related to the Application must be resolved in accordance with the laws applicable in Quebec before a Montreal district court.
